BC port supervisors' union challenges minister's back-to-work order, citing rights violation.
The union representing British Columbia port supervisors, Local 514 of the International Longshore and Warehouse Union, has applied for a judicial review of Labour Minister Steven MacKinnon's decision to order them back to work.
The union argues the order, which directs the Canada Industrial Relations Board to impose "final and binding arbitration," violates workers' rights to collective bargaining and striking.
The dispute led to a shutdown of port facilities from November 4 to 14.
Legal experts note the vague language in Section 107 of the Labour Code may allow labor groups to challenge such ministerial orders.
