Five Nelson police officers in B.C., Canada, are challenging the B.C. Police Act in a lawsuit, arguing that their privacy was violated when the act was used to obtain logs from a WhatsApp group chat in which they allegedly shared racist content. The lawsuit claims that the means of obtaining the chat logs contravened Section 8 of the Canadian Charter of Rights and Freedoms, which protects against unreasonable search or seizure. The officers argue that their WhatsApp communications were considered private due to the platform's end-to-end encryption and that the search and seizure of these records were unreasonable. The investigation, which began in February 2022, has yet to produce proven results.
