The North Carolina Supreme Court has ruled that Ace Speedway, a racetrack, can proceed with a lawsuit against the state over its COVID-19 closure. The court unanimously agreed that the speedway's attorney made plausible legal claims that the state violated their constitutional rights and conducted "unlawful selective enforcement" of its order. The case will now return to trial court to be heard, and is considered a legal defeat for Democratic Governor Roy Cooper.
