South Dakota's Supreme Court reversed decisions granting Summit Carbon Solutions common carrier status for its carbon capture and sequestration pipeline. The court ruled that Summit Carbon had not proved it's a common carrier transporting a commodity for hire, therefore the company can't use eminent domain to acquire private property. The decision benefits landowners who appealed against invasive surveys on their land.
