8th Circuit Court overturns lower court's injunction on Iowa's law banning sex-themed books, gender identity discussions in schools.
A federal appeals court has overturned a lower court's injunction, allowing Iowa's law to proceed, banning books depicting sex acts from school libraries and classrooms and prohibiting teachers from discussing gender identity and sexual orientations through the sixth grade. The Court of Appeals for the Eighth Circuit ruled that the District Court judge's preliminary injunction was based on a flawed analysis and vacated it. The law, which passed in 2023, was challenged by authors, publishers, and LGBTQ+ advocates who argued it violated their First Amendment rights.
