Alabama will proceed with a nitrogen gas execution in September, after settling a lawsuit with inmate Alan Miller. Miller, set to be the second person executed using nitrogen gas in Alabama, had sought to prevent the state from using the same nitrogen gas protocol that was used in the January execution of Kenneth Smith. The terms of the settlement were not disclosed, but Alabama Attorney General Steve Marshall described the settlement as a victory for the use of nitrogen gas as an execution method, stating that the state's nitrogen hypoxia system is reliable and humane.
