California lawmakers reformed PAGA to protect small businesses from frivolous lawsuits, but experts say ADA abuse by predatory trial lawyers also needs addressing.
California Governor Gavin Newsom and lawmakers recently reformed the Private Attorneys General Act (PAGA) to protect small businesses from frivolous lawsuits, but more needs to be done, say experts. They argue that the Americans with Disabilities Act (ADA) is also being abused by predatory trial lawyers, who exploit minor compliance violations to sue businesses, particularly minority-owned ones. To ensure that the ADA continues to serve its original purpose of promoting accessibility without undermining entrepreneurial spirit, lawmakers should consider addressing the issue of lawsuit abuse more holistically, by likewise addressing reforms that prevent frivolous ADA suits.
