Canada's Supreme Court to rule on Crown's obligation to increase payments under 1850 Robinson Treaties.
Canada's Supreme Court is set to issue a ruling on the Robinson Treaties case, which concerns Crown payments under the 1850 agreements that ceded land to the Crown in exchange for annual payments to the Anishinaabe of Lakes Huron and Superior. The payments have been frozen at $4 per person since 1875, despite a clause in the treaties stating they should increase over time. An Ontario Superior Court judge ruled that the Crown violated the treaties and had a mandatory and reviewable obligation to raise the payments as the land was developed. The Ontario Court of Appeal upheld most of this ruling, finding that the Crown breached its promise to share resource revenues. The Crown has appealed the case to the Supreme Court of Canada.
