2-year-old Mark Partain's family is filing a wrongful death lawsuit against Melissa and Jeffrey Phillips, owners of the dog that fatally attacked him on T.R. Christian Road in New Hope on March 1, 2024. The family accuses the Phillips of violating Emily's Law, relating to dangerous dogs in the community, for allegedly not confining the dog properly. The Phillips have also been charged with death by dangerous dog.
