Deputy Health and Disability Commissioner found an obstetrician/gynaecologist breached multiple rights in relation to using surgical mesh. The procedure involved a mesh suburethral sling, which was not discussed or documented with the patient beforehand, despite her not wanting mesh. The physician failed to provide informed consent and services with reasonable care, resulting in breaches of Rights 4(1), 4(2), 6(1), and 7(1).
