6th Circuit Court of Appeals orders Enbridge's Line 5 oil pipeline shutdown lawsuit to be heard in state court per missed deadline for jurisdiction change.

Michigan Attorney General Dana Nessel's lawsuit to shut down part of Enbridge's Line 5 oil pipeline beneath the Straits of Mackinac has been ordered to be heard in state court by the 6th U.S. Circuit Court of Appeals. The lawsuit seeks to void a 1953 easement that allows Enbridge to operate a 4.5-mile section of the pipeline, raising concerns over the pipeline's safety since 2017 when Enbridge revealed gaps in the section's protective coating. Enbridge had moved the case from state court to federal court more than two years past the deadline for changing jurisdictions, but the appellate panel found that Enbridge missed the deadline. The case will now be remanded to state court.
