A federal judge ordered BNSF Railway to pay nearly $400 million to the Swinomish Tribe in Washington state for trespassing with oil trains. BNSF Railway repeatedly ran 100-car trains carrying crude oil across the tribe's reservation, in violation of a 1991 easement agreement that limited the number of cars per day. The judge determined that BNSF Railway intentionally trespassed and must pay the tribe for their unauthorized actions.
