A North Dakota judge has denied a preliminary injunction to block the state's ban on gender-affirming care for children, allowing the law to remain in place as legal challenges proceed. The law, in effect since April 2023, makes it a misdemeanor for health care providers to prescribe hormone treatments or puberty blockers to transgender children and a felony to perform gender-affirming surgeries on minors. However, children who were receiving treatments before the law took effect can continue to receive their care. The judge stated that the public interest in maintaining the status quo outweighs the potential harm to the plaintiffs.
