Kenya's High Court orders Carrefour to refund Sh289,482 to Orchards Limited and pay a penalty of Sh124,768 to the Competition Authority for engaging in unfair practices.
The High Court of Kenya has ordered Carrefour, a supermarket chain under Majid Al Futtaim, to refund Sh289,482 to its former supplier, Orchards Limited, for rebates deducted and pay a penalty of Sh124,768 to the Competition Authority of Kenya for engaging in unfair practices. The dispute involved a contract between Carrefour and Orchards Limited, which supplied probiotic yogurt to Carrefour outlets, leading to Orchards' financial difficulties and closure. The court upheld the Competition Authority's determination that Carrefour possessed and abused its buyer power over Orchards Limited.
