Zimbabwe's Labour Court dismissed a case involving CIO employee Cloddy Shumba due to jurisdiction issues related to disciplined force status.
Zimbabwe's Labour Court has declined jurisdiction over a case involving the CIO and an employee, Cloddie Shumba, who was fired for allegedly signing contracts worth over $70,000 without proper authorization. The court ruled that the dispute falls outside its purview as it involves a disciplined force, with CIO arguing that the Labour Court lacks jurisdiction due to its status as a disciplined force. The judge found that section 3(3) of the Labour Act excludes disciplined categories such as the military, police, and persons employed in the President's office on security duties from Labour Court jurisdiction. The court thus struck off the case from the roll, with costs.
