The Supreme Court ruled that post-disinvestment, Air India Ltd isn't a state instrumentality, making current legal cases invalid.
The Supreme Court ruled that Air India Ltd (AIL) is no longer a state or its instrumentality after its disinvestment and takeover by Tata Group in Jan 2022. As a result, no violation of fundamental rights cases against AIL are valid, and they can't be subjected to the court's writ jurisdiction under Article 226. The court dismissed appeals against the Bombay High Court's Sept 2022 verdict, which disposed of AIL employees' writ petitions regarding issues like pay stagnation, employee non-promotion, and wage arrears delays.
