Bombay High Court declares right to sleep as a basic human need and prohibits nighttime questioning due to impaired cognitive skills.
The Bombay High Court has stated that the right to sleep is a basic human requirement that cannot be violated, and that statements must be recorded during earthly hours, not at night, when a person's cognitive skills may be impaired. The court made the statement in response to the Enforcement Directorate (ED) questioning a senior citizen throughout the night in a money laundering case. The court has directed the ED to issue a circular/directions, specifying the appropriate timings for conducting questioning when summons are issued.
