Supreme Court rules High Court can send quashed SHD planning applications back to An Bord Pleanála for reconsideration.
The Supreme Court ruled that the High Court has the power to send quashed planning applications back to An Bord Pleanála for reconsideration. This decision could impact 53 first-time planning applications made under the expired strategic housing development (SHD) process, which are yet to be determined. The ruling also applies to ten other pending court cases. The court unanimously dismissed an appeal against the High Court's decision to allow the board to reconsider an SHD planning application for 102 rental homes in Dún Laoghaire, Co Dublin.
