Athabasca Chipewyan First Nation sues Alberta Energy Regulator for negligence, uninformed tailings leaks, and violation of Treaty obligations.
The Athabasca Chipewyan First Nation (ACFN) in Alberta has filed a lawsuit against the Alberta Energy Regulator (AER), claiming negligence and a failure to uphold Treaty obligations. The lawsuit alleges the AER failed to inform the First Nation about tailings leaks at Imperial Oil's Kearl facility and seeks a declaration that the AER's regulatory framework is unconstitutional and infringes on ACFN rights. ACFN is also seeking damages for the impact of the leaks on their resources and fear of contamination.
