The British Columbia Court of Appeal has upheld a previous ruling that Vancouver General Hospital (VGH) breached standards of care when 83-year-old patient Ying Wei Zheng broke his hip in 2016.
The court rejected VGH's appeal and confirmed that one-to-one supervision should have been in place before Zheng fell.
The hospital had argued there was no evidence of a need for one-to-one supervision, as Zheng had no history of attempting to get out of bed.
However, the court emphasized that an assessment plan informs the standard of care, and certain steps should be taken based on the nature and severity of the risk of a fall.
