Australian retailer 4WD Supacentre fined AUD 302,500 by ACMA for sending unsolicited texts to customers without consent, including those who unsubscribed.

Australian retailer 4WD Supacentre has been fined $302,500 for sending 82,000 unsolicited texts and 1,575 messages to previously unsubscribed customers. The company had previously been penalized for spam compliance violations. Under Australia's Spam Act, businesses must obtain consent before sending marketing messages and provide recipients with an option to unsubscribe. As a result, 4WD Supacentre has been subjected to a three-year court-enforceable undertaking requiring an independent consultant to review its compliance with spam laws and make necessary changes.
